If your parents created a valid legal power of attorney and/or trust then you will not need to file for guardianship should they no longer be able to care for themselves and their finances. However, if no legal documents are prepared prior to the person becoming incapacitated, you may need to go to court to file for guardianship. This is expensive, time-consuming and public.
