Have a rich Uncle?

Let that rich Uncle or Aunt you know that they can give you up to $11,000 a year via a gift. The federal gift tax laws allow a person to make an unlimited number of gifts of up to $11,000 per year and these gifts do not reduce the unified credit of the person making the gift.

Why do people want to avoid probate?

The major reasons include the costs, time, lack of privacy. There are many expenses involved in Probate administration, including attorney's fees, court fees, executor's fees, accounting fees, etc. Obviously there may be more costs depending on the estate. In Illinois, a probate estate has to be open for at least six months. However it is common to see estates be open for one year or more. The probate estate court files are also matters of public record so there is a definite lack of privacy.

Potential problems of not having an estate plan

There are many potential problems if you don't have an estate plan. Among them include:

Land trusts in conjunction with estate planning

To avoid probate, consider a land trust.  Where the beneficial owner names a contingent beneficiary, the property will avoid probate by passing to the contingent beneficiary.  This arrangement avoids the time and expense of probate.
